General Terms and Conditions of Sale
Preamble
These General Terms and Conditions of Sale (hereinafter "GTCS") apply to any order placed on the website hopercollection.com (hereinafter the "Site"), published by HOPER, SAS with share capital of €1,000, registered with the Paris Trade and Companies Register (RCS) under number 107 281 107, whose registered office is located at 47 rue Vivienne, 75002 Paris (hereinafter "HOPER").
Any customer who places an order on the Site (hereinafter the "Customer") acknowledges having read these GTCS and having accepted them without reservation prior to validating their order.
Article 1. Products
HOPER markets high-end artificial plants, artificial flowers, and decorative planters. The essential characteristics of each product (dimensions, materials, finishes) are specified on each product page of the Site.
Product images are provided for indicative purposes and may present slight variations from the product delivered, without this being able to engage HOPER's liability.
Article 2. Prices
Product prices are indicated in euros (€) inclusive of all taxes, including French VAT at the applicable rate. Delivery charges are indicated separately before validation of the order.
HOPER reserves the right to modify its prices at any time. Products will be invoiced on the basis of the rates in force at the time of validation of the order.
Article 3. Order
3.1 The Customer places an order on the Site in accordance with the process in force. Validation of the order entails full and complete acceptance of these GTCS.
3.2 Any order placed on the Site is firm and final after confirmation of payment. A confirmation email is sent to the Customer at the address provided.
3.3 HOPER reserves the right to refuse or cancel any order in the event of a prior dispute with the Customer, suspicion of fraud, or stock shortage.
Article 4. Payment
Payment is made online at the time of the order, by bank card (Visa, Mastercard, American Express, Cartes Bancaires), Apple Pay, or any other means offered by HOPER at the time of the order.
Transactions are secured via the provider Shopify Payments, in accordance with PCI-DSS standards.
The charge is made upon validation of the order. The order will only be processed after actual receipt of payment.
Article 5. Delivery
5.1 Shipping schedule
HOPER shipments will begin between September and October 2026. Any order placed before this date will be fulfilled as soon as deliveries open. The Customer is kept informed by email of the shipping schedule for their order.
5.2 Delivery zones
HOPER delivers within mainland France, within the European Union, and internationally (quote on request for destinations outside the EU).
5.3 Delivery times
The estimated delivery times, from the dispatch of the parcel, are as follows:
- Mainland France: 2 to 4 working days
- European Union: 4 to 7 working days
- International: 7 to 14 working days
These times are given for indicative purposes. Any delay does not give rise to compensation or cancellation, except where exceeding 30 days after dispatch.
5.4 Receipt
The Customer is required to check the condition of the parcel upon delivery. In the event of apparent damage, they must mention it on the delivery slip and contact HOPER within 48 hours by email at contact@hopercollection.com with supporting photographs.
Article 6. Right of withdrawal
In accordance with articles L.221-18 et seq. of the Code de la consommation (French Consumer Code), the consumer Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to give a reason.
To exercise this right, the Customer must contact HOPER at the address contact@hopercollection.com clearly indicating their intention to withdraw as well as the references of their order.
Products must be returned in their original packaging, in perfect condition, within fourteen (14) days following notification of withdrawal. Return costs are borne by the Customer.
The refund is made within a maximum period of fourteen (14) days from receipt of the returned product, by the same means of payment as that used for the order.
Article 7. Guarantees
7.1 Legal guarantee of conformity (articles L.217-3 et seq. of the Code de la consommation (French Consumer Code)): the Customer has two years from delivery of the product to assert a lack of conformity.
7.2 Guarantee against hidden defects (articles 1641 et seq. of the Code civil (French Civil Code)): the Customer has two years from discovery of the defect to take action.
7.3 HOPER commercial guarantee: HOPER guarantees its products for two (2) years from receipt, with respect to shape, colour and structure, under normal conditions of use and in accordance with the care recommendations provided.
Excluded from the guarantee are: damage related to misuse, prolonged and non-recommended exposure (outdoors, intense direct sunlight, heat sources), a fall or impact, or a lack of care.

For any question, complaint or request relating to an order, the Customer may contact HOPER:

Article 9. Personal data
The Customer's personal data is processed in accordance with the Privacy Policy accessible from the footer of the Site, in compliance with the Règlement Général sur la Protection des Données (RGPD) (General Data Protection Regulation (GDPR)).
Article 10. Intellectual property
All elements of the Site (texts, images, logos, trademarks) are protected by intellectual property law and remain the exclusive property of HOPER. Any reproduction without prior authorisation is prohibited.
Article 11. Force majeure
HOPER cannot be held liable for any delay or failure to perform resulting from a case of force majeure, as defined by article 1218 of the Code civil (French Civil Code), or from any event beyond its reasonable control (pandemic, strike, natural disaster, etc.).
Article 12. Mediation
In accordance with article L.612-1 of the Code de la consommation (French Consumer Code), the consumer Customer may, in the event of a dispute not resolved amicably, use the following mediation service free of charge:

Article 13. Applicable law and jurisdiction
These GTCS are subject to French law. In the event of a dispute, and in the absence of an amicable resolution or resolution through mediation, the French courts shall have sole jurisdiction.
Article 14. Modification of the GTCS
HOPER reserves the right to modify these GTCS at any time. The applicable GTCS are those in force on the date of the order.
